Information You Provide: When you submit our contact or demo request form, we collect your name, email address, phone number, business name, website URL, monthly processing volume, and type of business. We use this information solely to respond to your inquiry and provide our services.

Transaction Data: To provide chargeback management services, we may receive transaction-level data from your payment processor or merchant account, including transaction IDs, amounts, cardholder dispute information, and order metadata. This data is used exclusively to identify, analyze, and resolve disputes on your behalf.

Automatically Collected Data: We collect standard web analytics data including IP address, browser type, pages visited, and referral source through cookies and similar technologies. This helps us improve our website and services.

We use collected information to: (a) respond to demo requests and sales inquiries; (b) provide, operate, and improve our chargeback management platform; (c) communicate service updates, alerts, and account information; (d) comply with legal obligations; and (e) protect against fraud and unauthorized activity.

While no system is completely secure, we are committed to protecting your data using commercially reasonable safeguards.

We retain personal data for as long as necessary to provide services and comply with legal obligations, typically no longer than 7 years for transaction and dispute records in accordance with financial regulations.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Merchant" or "you") and eDataPay Group, Inc., operator of BankAssure ("BankAssure," "we," "us"), governing your access to and use of the BankAssure chargeback management platform and services. By accessing our website or enrolling in our services, you agree to be bound by these Terms.

2. Services Provided

BankAssure provides chargeback management services including: (a) integration with Visa's Rapid Dispute Resolution (RDR) system; (b) Mastercard Ethoca alert monitoring; (c) AI-powered dispute representment; (d) chargeback ratio monitoring and reporting; and (e) root-cause analytics. Services are provided on a subscription or transaction basis as agreed in your service agreement.

3. Merchant Eligibility and Responsibilities

To use BankAssure services, you must: (a) operate a legitimate business with a valid merchant account; (b) provide accurate and complete information during enrollment; (c) maintain sufficient authority to authorize chargeback management actions on your merchant account; and (d) comply with all applicable Visa, Mastercard, and card network rules and regulations.

You are responsible for maintaining the accuracy of your account data, ensuring your transaction records are complete and accessible, and promptly notifying us of any changes to your merchant account or processing arrangements.

4. Fees and Payment

BankAssure charges fees as outlined in your executed Service Agreement. Setup fees, if applicable, are disclosed prior to enrollment. Monthly service fees are billed in advance. Transaction-based fees are billed monthly in arrears. We reserve the right to adjust fees with 30 days written notice. Failure to pay fees may result in suspension or termination of services.

5. No Guarantee of Results

While BankAssure uses industry-leading technology and network integrations to prevent and contest chargebacks, we do not guarantee specific outcomes including win rates, chargeback ratio reductions, or prevention of MID termination. Results vary based on individual merchant circumstances, transaction history, and card network rules.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BANKASSURE AND EDATAPAY GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF MERCHANT ACCOUNT, OR LOSS OF BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

7. Term and Termination

Services commence upon execution of a Service Agreement and continue month-to-month unless otherwise specified. Either party may terminate with 30 days written notice. BankAssure may terminate immediately upon material breach of these Terms, fraudulent activity, or violation of card network rules.

8. Confidentiality

Both parties agree to maintain the confidentiality of proprietary information exchanged in connection with the services, including merchant transaction data, dispute strategies, and platform technology. This obligation survives termination of services.

9. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Palm Beach County, Florida.
